We reserve the right, at our sole discretion, to change, modify, add, amend or remove any part of these Terms and Conditions from time to time and it is your responsibility to check these Terms and Conditions from time to time for changes. It is a hassle we know, but we definitely would advise you to do so. We may modify or withdraw, temporarily or permanently, the Site (or any part of it) and we shall not be liable to you or any third party for any modification to or withdrawal of the Site. Product Descriptions on our Site
We will do our best to ensure that all Product Descriptions are correct at the time when the relevant information was first entered onto the Site. We have made every effort to display as accurately as possible the appearances, colours, textures or finishes of our Products. What you see will depend on your computer model, screen/monitor and we are therefore unable to guarantee that a Product's images are an accurate representation of the actual merchandise. Please refer to our Returns Policy if you are unhappy with your Order.
Product Availability
The Site features Products that have been carefully selected for sale on it. Products are subject to availability so once a Product has sold out it will be taken off the Site and/or marked as sold out/out of stock at the earliest opportunity and may not be available again. As there is a delay between the time when your Order is placed, and the time when the Order is accepted, the stock position relating to particular Products may change. If a Product you have ordered goes out of stock before we accept your Order, then ·ONE·JAM·TART· shall not be liable to you for being unable to provide that Product. If such a situation arises, then we shall notify you as soon as possible and you will not be charged for the out of stock Product.
Pricing Policy
All Product prices are in pounds sterling (£) and does not include any UK Value Added Tax (VAT). This is because as a tiny startup, we are not VAT registered allowing us to keep prices a little lower for customers like you (hopefully). Prices are correct at the time that the Product Description was first entered on to the Site. Prices of Products may change from time to time and any promotional discounts or offers may also be withdrawn at any time.
Although we try to ensure all our Product's prices displayed in the Product Description are accurate, silly errors may sometimes occur. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to Product description, pricing and availability.
If we discover an error in the price of a Product you have ordered we will contact you as soon as possible in order to notify you of the error and find out how you would like us to proceed with your order. We apologize for any inconvenience this may cause you. If we are unable to contact you, we will treat your Order in respect of the incorrectly priced item as cancelled.
If we have mistakenly listed the price of a Product lower than it should be, then we, in most cases, will honour the lower price listed. However, we reserve to right to refuse or cancel any orders placed for any Products listed at the incorrect price. We also reserve the right to refuse or cancel any Orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall issue a payment to your credit card account or online bank account in the amount of the incorrect price.
Age restrictions
You must be 18 years old or older to use this Site. If you are under 18, you may only use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use this Site.
Order process
You are deemed to place an Order with us and create a contract of sale by ordering via our online checkout process. Items can be added to the shopping basket by choosing a size and quantity followed by clicking the button ‘add to cart’. You can either continue shopping or go to the checkout. You will be guided through the process of placing an Order by a series of simple instructions on the Site. When placing an Order, you agree that any and all information given is accurate and complete. As part of our checkout process you will be given the opportunity to check your Order and to correct any errors. We will send you an Order acknowledgement by email to the email address given in your Order form, detailing the Products you have ordered, payment method, and all costs.
You must check all the details on this Order acknowledgement email are correct and contact us as soon as possible if any details are incorrect.
If your Order has not been accepted, you will receive an email from us telling you the reasons why. This order acknowledgement email does not constitute an acceptance of your Order by us.
Our acceptance of an Order takes place when we dispatch the Order. We will send you a dispatch confirmation by email. When we dispatch the Order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your Order or you have cancelled your Order.
You will assume the risk for the Products once they have been delivered to the delivery address that you specified when ordering the Products. We accept no liability where you provide an incorrect delivery address or where you fail to collect the Products from the delivery address that you specified.
We may refuse to accept an Order: i) where goods are not available; ii) where we are unable to obtain authorization for your payment; (iii) if there has been a pricing or Product description error; or (iv) if you do not meet any eligibility criteria set out in these Terms and Conditions.
The Products sold on the Site are not for re-sale or distribution. We reserve the right to cancel Orders where we believe Products are being ordered in breach of this provision.
·ONE·JAM·TART· takes all reasonable care, in so far as possible, to keep the details of your Order and payment secure, but in the absence of negligence on our part we will not be liable for any loss you may suffer if a third party procures unauthorized access to any Personal Information you provide when accessing or placing an Order on the Site. The contract of sales between you and ·ONE·JAM·TART· will be concluded in English and subject to the laws of England and the jurisdiction of the English courts.
Payment Process
All credit/debit card transactions/information are processed through STRIPE, a safe, easy to use and a very cost effective third party payment processor for businesses and individuals to send and receive money, which handles this information securely.
All major debit cards and credit cards, such as Visa, MasterCard, and American Express are accepted by Stripe. Stripe accepts payments in 139 currencies and even accepts Bitcoin and Apple Pay.
None of your credit/debit card information is stored anywhere on this site. Stripe’s use of your personal information is governed by their respective privacy policy which may or may not contain privacy protections as protective as our privacy policy. Unfortunately, we currently do not accept PayPal payments, however, we may implement payment by PayPal in the future. If PayPal payments is something that you need, please get in touch with us through our CONTACT page and let us know.
We only accept payment for Orders in pounds (£) sterling. If you choose to pay for your Order using a payment card with a foreign currency denominated account, the account will still be taken in pounds (£) sterling at the foreign exchange rate applied by your relevant credit card provider or bank at the time of processing your Order. Your international credit card provider or bank will determine the exchange rate and may add an additional processing or administration charge that you will be liable to pay. Please be aware your actual conversion rate will be set by your credit/debit card company and may differ from rates elsewhere.
By placing your Order and making an offer to buy a Product, you give us permission to transmit information (including any updated information) or to obtain information about you from third parties from time to time and this may include verification checks involving your credit/debit card number or credit reports in order to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization, to protect you and us from fraud; and to enable us to arrange delivery of your Order to your nominated delivery address. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.
VAT and International Customs
As a small startup, ·ONE·JAM·TART· is not required to be VAT registered as in order to keep our prices as low as possible, we have chosen not to register for VAT. As a result, all of our prices do not include VAT. We reserve the right to register for VAT and start charging VAT but will amend prices and terms and conditions as appropriate.
Where you have requested delivery of your Order to a non-UK country, the total cost of your Order may be subject to import duties and taxes, which are levied once a delivery reaches your destination country. Any such additional charges must be borne by you. You should note that customs policies and practices vary widely from country to country. We recommend that you contact your local customs office for information.
Please note that when shipping goods from outside of the United Kingdom, cross border shipments may be subject to opening and inspection by customs authorities. You will be the importer for the international delivery of your Order (i.e. any Order delivered to a country other than the UK). Therefore, before placing an Order, it is your responsibility to check that the Products you are planning to import comply with state and federal government import regulations, and that there are no local requirements or restrictions which may affect receipt of your Order.
Promotional discounts, coupons and gift cards
Any Coupons or promotional discount offered on the Site is valid only for use as part of a purchase made via the Site, unless otherwise stated and subject to availability.
Coupons or gift cards cannot be exchanged for cash or refunded.
Coupon codes must be entered at the checkout when prompted. Discounts cannot be redeemed on past purchases
Gift message
If you need to include a gift message with your Order, please let as know at the time of placing your Order. We do not take any responsibility for the contents of messages communicated by you to a third party. When you use this facility you agree that your message will not include any material that could be construed as defamatory, abusive, obscene, racist, offensive, harassing, threatening, vulgar or which could cause embarrassment or distress to any person. You agree not to impersonate any person, including but not limited to any of our employees or customers. The gift message facility is currently only available in the Latin alphabet with standard characters.
Delivery/Shipping
You must provide us with complete and accurate delivery address information. This includes not only the address that your Order is going to, but also the name of its recipient. We cannot be liable for the delivery of your Order to the wrong address or the wrong person as a result of you supplying us with incomplete or inaccurate information.
We do not send to PO BOX addresses.
Please note that delivery of your Order may take longer during sale or other busy periods.
Deliveries within the UK
Will be free of charge.
If you require Products from the same Order shipped to multiple addresses, please let us know at the time of placing your Order.
Please notify us if your Order has not been received within 14 days of Order confirmation.
We offer deliveries via Royal Mail using the Royal Mail Signed For service and so will require a signature on receipt.
Delivery lead times of your Order within the UK will usually take 1-3 days.
We do not guarantee next day delivery.
International Deliveries
Will be FREE ON ORDERS OVER £90. Otherwise, international delivery will cost as follows: EU - £10, Rest of the world - £15.
International delivery charge(s) applicable to your Order will be applied at the checkout and the amount will be added to the total amount of your Order.
Via Royal Mail: Our first choice will be to use the Royal Mail International Tracked and Signed service which will require a signature on receipt, but where that service is not available, we will use one of the other Royal Mail International services to deliver your Order.
Royal Mail ship to 39-180 countries around the world, depending on the type of international service used, with delivery times dependent on which country you are in.
Delivery lead times of your Order to an international address will vary according to its destination, but will usually take 5 -7 days to Europe and 7-14 days to the rest of the world. We will make every effort to deliver your Order within the estimated timescales. However delays are occasionally inevitable due to unforeseen factors or events outside our control, for example, material shortages, travel or transportation disruption, import delays or higher than anticipated demand. ·ONE·JAM·TART· shall not be liable for any delay or failure by us to deliver your Order within the estimated timescales.
International delivery option is automatically calculated as part of the checkout process when you specify a delivery address outside of the UK. For the purposes of these Terms and Conditions, we consider "international delivery" to relate to the delivery of your Order to a country outside of the UK.
We are dependent on Royal Mail for deliveries and unfortunately, for those countries where Royal Mail do not offer a Signed and/or Tracked service, we are unable to track and monitor deliveries. While we will of course do our best to make sure that you receive your order, we are not able to accept liability over lost deliveries.
Please notify us if your Order has not been received within 28 days of Order confirmation.
Contract of sale cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
If you are an EU customer, you have the right to cancel your contract of sale at any time up to 14 days after the day on which you receive your Order. If you place an Order for several Products and they are delivered separately then your 14 days will start the day after you receive the last Product on your Order.
Cancellation before dispatch or notification of collection
If for any reason, you wish to cancel your contract of sale before your Order has been dispatched, then you need to let us know via the ways shown on our CONTACT page. Once we have received notification by you of your wish to cancel your contract of sale, subject to any monies having been taken from you, we will refund you the original purchase price and any delivery charge of your Order within 14 days.
Cancellation after dispatch or notification of collection
Since we try to process your Order immediately it may not always be possible to stop an Order from being dispatched. If you decide to cancel your contract of sale, but your Order has already been dispatched, then you need to let us know within 14 days after the day on which you receive your Order. You can notify us via the ways shown on our CONTACT page. Once we have received notification by you of your wish to cancel your contract of sale, you then have a further 14 days to return your Order to us.

If you are a Non-EU customer, then these legal rights do not apply to you. In the event that you do not wish to keep your Order, you need to send this back to us within 14 days after the day on which you receive your Order. For more information on how to do this, please see our Returns Policy.
Returns Policy
Please kindly notify us through our CONTACT page that you are returning your Order and your reasons for doing so. We’d love to hear your feedback.
If you would like to return your Order to us please do so within 14 days of receipt for UK and also international Orders, and we will happily either send out a replacement Order or refund you the purchase price.
Products must be returned in a saleable condition meaning that they must be unused, undamaged, unmarked in anyway with pen or grease, unwashed, free from smells of smoke, aftershave, perfume, deodorant or washing powder, and in their original packaging with garment tags, swing tags, labeling, branding, any accompanying marketing material specific to the item and any other security devices or seals still attached and intact.
The customer is responsible for the item returning to us, please make sure you take adequate steps to ensure the security of the contents during transit back, we cannot be held responsible for exchange or refund if reasonable steps are not taken. We reserve the right to consider the condition of any Product that you wish to return and will make any necessary deductions if there are indications that the Product, its tags, security devices or seals having been used, removed, broken or tampered with.
Please kindly note that to be eligible for a refund you have 14 days from when we have sent you your Returns Label to return the goods back to us.
Free UK Returns
Returning items to us is easy and best of all free.
Via Collect+ : We accept returns via the Collect+ Return service as used by many household named stores. Please get in touch with us to let us know that you would like to make your return via Collect+ and we will forward you by email a PDF label for you to print out and attach to your returns parcel. You can then drop off your item at over 3500 local shops across the country at a time convenient to you. You'll receive proof of postage, insurance and an online tracking code so that you can follow your parcel's progress back to us. Collect+ services are delivered securely by PayPoint and the Home Delivery Network.
International Returns
Even if you are an international customer, we want you to know that while we hope you never find yourself in the situation where you need to return a product, we try to make the process as painless as possible.
Unfortunately, we are unable to offer free international returns. We will still offer refunds but all products will have to be returned to ·ONE·JAM·TART· at the cost of the customer.
All sale/discounted items are non refundable but can be exchanged within 7 days of receipt.
When returning orders, please mark your parcel as “Returned Goods” on the outer packaging and any commercial invoicing to avoid any additional charges and delays getting back to us.
Refunds policy | Refunds on an UK Order
Within 14 days of us receiving your Order back by post, or receiving proof from you that your Order was returned to us, we will refund you the original purchase price and, if needed, the delivery charge for your Order, provided that your returned Product(s) are in a saleable condition as mentioned above. The refund of your Order's original purchase price will be refunded automatically.
Refunds will be issued back to the credit or debit card which you used to place your Order. This will appear in your account usually within 5 days depending on your card issuer.
Refunds policy | Refunds on an Non-UK Order
If you placed your Order online and paid for it to be delivered to a Non-UK country, then within 14 days of receiving your Order back by post we will refund you the original purchase price for your Order, provided that your returned Product(s) are in a saleable condition as mentioned above. Please note that we will not refund any applicable local customs duties charged to you by your local customs authority. Certain countries permit refunds of customs duties paid on Products you subsequently return. However, you will need to apply to your local authority to process that.
Promotional discounts and refunds
If a Coupon discount code was originally applied to your Order, then the same discount will be applied to each Product of your Order that you return. This means that you will only be refunded the amount that you originally paid for your Order on any given Product.
All competitions
We reserve the right to amend these Terms without notice from time to time.
These rules will be deemed incorporated into each competition except to the extent that any specific instruction in a competition provides otherwise.
By entering the competition entrants will be deemed to have read and understood these Terms and be bound by them. All of our decisions will be final and binding and no correspondence will be entered into.
Any person who is an employee or an immediate family member of an employee of ·ONE·JAM·TART· or any other person who is directly connected with ·ONE·JAM·TART· of any particular competition is ineligible to participate.
Competitions are only open to anyone unless certain restrictions are specified or implied.
All entrants are to be aged 18 or over unless any other age restriction is specified or implied. Entrants should, if under 18, obtain permission in advance from their parent or guardian.
All entries must be received by the closing date specified in the competition.
Answers will be entered upon submission. No responsibility will be taken for any answers that are misdirected, lost for technical or other reasons or received after the closing date.
We reserve the absolute right to disqualify without notice any entries to any competition which we consider have used improper technical means to enter and/or we believe is fraudulent.
Entrants are liable for their costs to access computer networks.
Prizes
We will not be liable for or accept any responsibility for: (i) any failure by the winner or any entrant to comply with these terms and conditions; (ii) any disruption, delay or misdirection of entries; or (iii) any server, system or network failures, malfunctioning or inaccessibility.
We shall be the promoter of all competitions subject to these terms and conditions unless stated otherwise.
If for any reason an advertised prize is unavailable we reserve the right at our absolute discretion to substitute a similar prize of equivalent or greater value.
Only one prize will be awarded per household.
There will be no cash or other alternative to the prize offered and prizes are
not transferable.
Winner Notification
The winner's name will be selected in a random draw or unless otherwise specified, after the closing date, from all correct answers received.
The winner of a prize will be notified within 28 days after the winner has been ascertained.
Please allow 28 days for delivery of all prizes.
If the winner of the a competition is unable to take up a prize for any reason or if the winner cannot be notified after reasonable efforts having been made then we may dispose of the prize as we think fit without any liability to the winner for having done so.
For each competition, only one prize will be awarded per entrant / email address. Names of winners will be available on request.
Reviews
If you submit a review, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
You grant ·ONE·JAM·TART· the right to use the name that you submit in connection with such content, if they choose.
You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.
You represent and warrant that you own or otherwise control all of the rights to the content that you have accurately posted
Gift With Products Promotions
Where we are offering a free gift with a Product, we shall only provide one free gift per transaction (irrespective of how many Products are purchased). The free gift is subject to availability and we reserve the right to change the free gift for a gift of equivalent value.
In order for us to facilitate the provision of a free gift, it may be necessary for us to include the free gift on our site at a nominal value. For the avoidance of doubt, you are not entitled to 'purchase' the free gift without purchasing the Product it is provided free with and any attempt to 'purchase' the free gift will be cancelled (notwithstanding any automated communication you may receive acknowledging your Order). In the unlikely event that the free gift is dispatched to you, you shall be obliged to return the free gift upon written request.

We take the risk of Internet fraud very seriously. With the volume of fraudulent credit card transactions increasing, we make every effort to ensure all Orders are thoroughly checked using the information already supplied. There is a possibility we may contact you to make additional security checks and we ask for your co-operation to enable us to complete them. We will not tolerate fraudulent transactions and such transactions will be reported to the relevant authorities.
By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
Prohibited Materials & Activities
Please carefully choose the material you post on the Site and which you provide to other Users. You must not misuse the Site in any way, shape or form. You must not: send or otherwise post unauthorised commercial communications to Users (such as spam); upload viruses, trojans, worms, logic bombs or other malicious code; corrupt data; cause annoyance to other Users; post material that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence; use the Site to do anything unlawful, misleading, malicious or discriminatory; facilitate or encourage any violation of these Terms and Conditions.
We reserve the right to reject, edit or refuse to post any material and to remove any material from the Site, whether or not the material is expressly prohibited by these Terms and Conditions, or to restrict, suspend, or terminate your access to all or any part of the Site at any time, for any or no reason, with or without prior notice, and without liability.
Linking to the Site
You must not establish any link to the Site to suggest any form of association, approval or endorsement on our part where none exists or establish a link from any Site that is not owned by you.
Compliance with Laws
The Site may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Site and any transactions conducted on or through the Site.
Liability and Indemnity
While we will use reasonable efforts to verify the accuracy of any information we place on the Site, we make no warranties, whether express or implied in relation to its accuracy. The Site may also contain links to other websites, which are not operated by ·ONE·JAM·TART·. You agree to fully indemnify, defend and hold us and our agents, officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms and Conditions (including Community Area Rules) by you or any other liabilities arising out of your use of the Site, or the use by any other person accessing the Site using your Personal Information.
We may terminate your use of the Site immediately if we consider that you have breached these Terms and Conditions.
Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
Severance
If any part of the terms and conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these terms and conditions and shall not affect the validity and enforceability of any of the remaining provisions of the terms and conditions.
Waiver
No waiver by use shall be construed as a waiver of any preceding or succeeding breach of any provision.
Survival
Each provision of these terms and conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.
Comments & Complaints Procedure
If we have done something exceptionally well, or if we have royally messed up bad, please contact us via the ways shown on our CONTACT page to let us know of any comments or complaints that you may have. We aim to put 100% effort to resolve any dispute as swiftly as possible.
General
We may change these Terms and Conditions at any time. If any clause of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that clause shall be deemed severable from the Terms and Conditions and shall not affect the validity and enforceability of the remainder of these Terms and Conditions, which shall continue to have full force and effect.

"Non-UK" means any other country not listed in the definition of UK below.
